Three Sentenced To Prison For Violation of Probation

On September 21, 2015, Fentress County Criminal Court Judge, E. Shayne Sexton, ordered that Theodore T. Sexton, David Wayne Hurst, and Korey Dustin Allen Hayes serve their respective sentence in the custody of the Tennessee Department of Corrections after each defendant was found to have violated the terms and conditions of their respective probation.

Theodore T. Sexton pled guilty to Theft over $1,000, a Class D Felony, on August 11, 2014.  He was sentenced to a four year year sentence and was placed on supervised probation for four years.  Mr. Sexton violated his probation by his failure to report to his probation officer, and by incurring a new charge of Evading Arrest.  Mr. Sexton’s probation was revoked after he was found in violation of probation for a second time.

David Wayne Hurst pled guilty to Reckless Aggravated Assault, a class D. Felony, and Assault, a class A misdemeanor, on March 7, 2011.  He was sentenced to a three year sentence and was placed on supervised probation for three years.  On April 9, 2014, his probation was extended for an additional two year period.  Mr. Hurst violated his probation by incurring a weapon charge and non-payment of fines, court costs and restitution.  Mr. Hurst’s probation was revoked after he was found in violation of probation for a second time.

Korey Dustin Allen Hayes pled guilty to DUI, a cdlass A misdemeanor, Simple Possession of Marijuana, a class A misdemeanor, Escape, a class A misdemeanr, and Conspiracy to Commit Aggravated Assault, a class E felony, on June 08, 2015.  He was sentenced to a two year sentence and an 11 month and 29 days sentenced, and was placed on supervised probation for three years.  Mr. Hayes violated probation by failing to report to his probation officer, failing to abstain from drug use, and by receiving new misdemeanor driving charges.  Mr. Hayes’ probation was revoked after he was found in violation of probation.
