An order for the sale of real property was entered in the above-styled case on May 17, 2016, permitting the Circuit Court Clerk to advertise and sell the below-described property.

You are, therefore, notified that on Friday, June 24th, 2016 at 10 a.m. C.D.T., there will be a sale on the premises which is located east of 1141 Tom Price Road, Jamestown, Tennessee 38556.

Tract One: Map 75, Parcel 9.02

Directions to the property: From the courthouse in Jamestown, Highway 52 East southeastwardly towards Allardt a distance of 2 1/2 miles to the Tom Price Road; thence east on Tom Price Road a distance of .7 mile to the Price Cemetery Road; thence north on the Price Cemetery Road a distance of approximately 300 feet.

Directions to the property: From the courthouse in Jamestown, Highway 52 East southeastwardly towards Allardt a distance of 2 1/2 miles to the Tom Price Road; thence east on Tom Price Road a distance of .7 mile to the southeast corner of the Kathy Crabtree tract. The property is on the north side of the Tom Price Road between the Kathy Crabtree tract on the west and the Charolette Price Austin one acre tract on the east.

The property contains one acre, more or less; and being a tract of land sold to James W. Price recorded on November 25, 1972 in Deed Book W-4, page 235 of the Register’s Office of Fentress County, Tennessee to which reference is made for contents.

Excepting, however, from this conveyance, any mineral rights which may have been reserved by prior owners.

Both deeds are filed in the Register of Deeds Office. They have some distances and directions, but no recent survey has been made of the properties.

Full legal descriptions of properties are available in the Register of Deeds Office in the old court house in Jamestown, from the Office of the Circuit Court Clerk at the Justice Center or from the Law Offices of S.N. Garrett or Romer, Lane & Howard, PLLC in Jamestown.

Pursuant to T.C.A.§35-5-104, there are no liens claimed by the United States of America to which 26 U.S.C.§ 7425(b) requires notice to be given to the United States. Also there are no liens claimed by the State of Tennessee with respect to which T.C.A.§ 67-1-1433(b)(1) requires notice to be given to the State. Also there are no other interested parties or mortgage holders on the property to which notice needs to be given.

The property will be sold for cash with twenty percent (20%) down the day of sale, balance due upon confirmation by the Court, and in bar the statutory and equitable rights of redemption, and on such other terms and conditions as may be set by the Clerk the day of the sale. All further questions are reserved, including questions relevant to the disposition of proceeds, sale, the fees and costs. Announcements on the day of sale take precedence over all previous announcements or advertised material. Purchaser will be responsible for payment of the 2016 property taxes.

Upon confirmation of the sale, the Plaintiff and Defendant shall be divested of title and purchaser vested with title. The Clerk shall make a deed or deeds to the purchaser(s).

The Substitute Trustee reserves the right to postpone or set over the date of sale in the event the Substitute Trustee deems it best for any reason at the time of sale to postpone or continue this sale from time to time, which such notice of postponement as deemed reasonable by the Substitute Trustee. In the event the highest bidder at such sale fails to complete his purchase of the subject real property within applicable time allowed, the undersigned Substitute Trustee reserves the right to complete the sale of the subject real property, without further notice or advertisement, to the next highest bidder who is able to consummate his purchase of the property within the time permitted by the Substitute Trustee.
