NOTICE OF TRUSTEE’S

SALE OF REAL ESTATE

WHEREAS, on the 30th day of November, 2012, RHONDA WRIGHT did make, execute and deliver a certain Deed of Trust to Stephen L. Rains, as Trustee, to secure the payment of a certain Promissory Note of even date therewith, with said Note being payable to Progressive Savings Bank.  Said Note is more fully described in said Deed of Trust of record in Book 206, Page 864, recorded on November 30, 2012, and to which Deed of Trust reference is hereby made; and

WHEREAS, default has been made in the terms, conditions and payments provided for in said certain Note heretofore mentioned, and the holder and owner of said Note has declared the entire unpaid principal balance of said Note, together with all accrued and unpaid interest, due and payable as provided in said Note and Deed of Trust.

WHERAS, F. Matthew Curtis was appointed Successor Trustee of the above described instrument as evidenced by that Appointment of Successor Trustee recorded on August 9, 2019, in Record Book 303, Page 464; and

Potter and Hollis A. Neal to Ike Blevins, Jr., et ux dated July 14, 1980 and recorded in Deed Book T-5, Page 661, of the Register’s Office of Fentress County, Tennessee and running thence north 43 degrees 11 minutes west 481.4 feet to a metal pin located north 65 degrees 36 minutes east 204.4 feet from the northeast corner of said Blevins lot; thence north 65 degrees east 221.1 feet to a metal pin; thence south 36 degrees 02 minutes east 471.2 feet to a metal pin at the west edge of Highway 154; thence south 66 degrees 48 minutes west 161.1 feet to the beginning and containing 2.01 acres, more or less.

The Honorable Todd Burnett heard this case on August 15, 2019 upon Plaintiff’s Motion for Order of Publication.  Upon statement of counsel, the sworn motion and the record as a whole, the court finds:

1. On April 8, 2019, Ms. Gunter filed a Petition for Contempt in the General Sessions Court for Fentress County, Tennessee.

2. On April 10, 2019 a Summons requiring Jonathan Gunter to serve an answer to the Petition for Contempt was sent via Certified Mail to Mr. Gunter at his last known address;

3. Mr. Gunter’s last known address is 138 Shirley David Road, . 

4. The envelope containing the Summons was returned to sender stamped “Unable to Forward For Review,” and that at least two attempts to deliver had been made.

Therefore, the court orders that Jonathan Gunter  is required to appear and answer or otherwise defend against the petition filed by Patricia Gunter, whose attorney is Melanie S. Lane, P.O. Box 797, Jamestown, Tennessee 38556, within thirty (30) days after the date of the last publication of this notice, otherwise default judgment may be entered against him.
