NOTICE OF TRUSTEE’S

SALE OF REAL ESTATE

WHEREAS, on the 16th day of November, 2012, ROBERT L. MINSHALL and wife, WANDA J. MINSHALL did make, execute and deliver a certain Deed of Trust to Stephen L. Rains, as Trustee, to secure the payment of a certain Promissory Note of even date therewith, with said Note being payable to Progressive Savings Bank.  Said Note is more fully described in said Deed of Trust of record in Book 206, Page 487, recorded on November 16, 2012, and to which Deed of Trust reference is hereby made; and

WHEREAS, default has been made in the terms, conditions and payments provided for in said certain Note heretofore mentioned, and the holder and owner of said Note has declared the entire unpaid principal balance of said Note, together with all accrued and unpaid interest, due and payable as provided in said Note and Deed of Trust.

WHERAS, F. Matthew Curtis was appointed Successor Trustee of the above described instrument as evidenced by that Appointment of Successor Trustee dated 19th April, 2019 and recorded on April 22, 2019, in Record Book 298, Page 535; and

THEREFORE, in accordance with the terms of the Deed of Trust and by virtue of the power and authority vested in the undersigned by the aforesaid Deed of Trust, the public is hereby notified that the undersigned Trustee, having been requested so to do by the said holder and owner of the Note, will sell the hereinafter described real estate at public auction to the highest and best bidder for cash in hand (or credit upon the indebtedness secured if the holder of the secured indebtedness is the successful bidder) at the front door of the Fentress County Courthouse in Jamestown, Tennessee, at the hour of 11:00 a.m. prevailing time on Thursday, the 16th day of May, 2019; said property will be sold in bar of all right and equities of redemption, homestead, dower and all other exemptions of every kind from the borrower which are expressly waived by the terms of said Deed of Trust; said real estate will be sold without any warranties as to liens, existing highway, roadway and utility easements, applicable building and zoning regulations, such state of facts as an accurate survey would disclose, to all encumbrances, Federal Tax Liens, assessments, and mechanics’ and materialmen’s liens.  The Trustee will pay any state, county or municipal taxes due on the property through the year 2018 and the purchaser at this sale shall be responsible for taxes for 2019 and thereafter.  The undersigned Trustee will execute a Deed to the purchaser as Trustee only.  The proceeds of this sale will be applied as set out in the Deed of Trust.  The real estate to be sold is located in Fentress County, Tennessee, and is more particularly described as follows:

LEGAL DESCRIPTION

Lying and being in the First Civil District of Fentress County, Tennessee about 2 miles south of the Courthouse in Jamestown by way of U.S. Highway 127 to the Glenobey Road; thence westwardly on the Glenobey Road a distance of approximately 1180 feet to a right—of—way on the south margin of the Glenobey Road; thence southwardly on said right—of—way a distance of approximately 270 feet and beginning at a stake on the west margin of said right—of-way and running thence with the south line of another right—of—way through the Ovas and Oval Turner property north 56 degrees 58 minutes 43 seconds east 547.764 feet to a stake; thence leaving said right—of—way south 0 degrees 51 minutes east 350.88 feet to a stake; thence north 86 degrees 39 minutes 36 seconds west 208.679 feet to a stake; thence north 87 degrees 36 minutes 16 seconds west 239.411 feet to a stake; thence north 29 degrees 22 minutes 47 seconds west 34.62 feet to the beginning corner and containing 2.2 acres, more or less.

The grantors also convey a permanent easement and right—of—way 40 feet wide adjacent to and on the north side of the north line of said property running the entire length of the property from the northwest corner to the northeast corner and complete access to and an easement to the street running southwardly from the Glenobey Road to the subject property.

Conveyance is subject to the reservation of an easement right—of—way 32.9 feet wide adjacent to and on the east side of the 34.62 foot west line of the aforesaid tract and running from the south line of said property north 29 degrees 23 minutes west to the north line of said property at a street which the grantee may use, which reservation is set out in the deed from Maggie Turner, et al to Western Sportswear Company, Inc., recorded in Deed Book X—5, Page 191, in the Register’s Office of Fentress County, Tennessee and subject; to mineral reservations contained in former deeds.

Being the same property described in a deed from Robert S. Arms and wife, Kathy Arms, to Ricky W. King and wife, Lisa Shannon King, recorded in Book 35, Page 696 in the Register’s Office of Fentress County, Tennessee.

Previous and last conveyance being a General Warranty Deed from RICKY W. KING and wife, LISA SHANNON KING to ROBERT MINSHALL and wife, WANDA MINSHALL, recorded on November 16, 2012, in Book 206, Page 484, in the Register’s Office of Fentress County, Tennessee.

In the event the highest bidder at the foreclosure sale should fail to comply with the submitted bid, the Trustee shall have the option of accepting the next highest bid with which the bidder is able to comply, or readvertise and sell at a second sale.

The right is reserved to adjourn the day of the sale to another date certain without further publication upon announcement at the time and place herein set for the above sale.
