NOTICE OF TRUSTEE’S SALE OF REAL ESTATE

WHEREAS, on the 23rd day of March, 2012, HBS PROPERTIES, LLC did make, execute and deliver a certain Deed of Trust to Stephen L. Rains, as Trustee, to secure the payment of a certain Promissory Note of even date therewith, with said Note being payable to Progressive Savings Bank. Said Note is more fully described in said Deed of Trust of record in Book 197, Page 697, recorded on March 29, 2012, and to which Deed of Trust reference is hereby made; and

BEGINNING where the West line of Entry No. 408, Grant No. 4661, known as the William Lee Tract, crosses Clear Fork River; thence North with the line of said Entry No. 408 to the North line of Grant No. 10618; thence West with said grant line about three hundred forty-two (342) poles to a stake North of the beginning corner of said Grant No. 10618; thence South with the line of said grant to Rock Branch; thence down said Rock Branch and down the Brushy Fork, with their meanders, to the beginning, containing two hundred fifty-five (255) acres, more or less.

Tract B:

Lying on the waters of Brushy Fork, described as follows: BEGINNING at a double white oak, the beginning corner of Grant No. 9949; thence South five hundred eleven (511) poles, more or less, to a white oak, the southwest corner of said grant; thence East three hundred thirty-three (333) poles, more or less, to the Southeast corner of said grant; thence continuing East to the Brushy Fork; thence Northwestwardly with said Brushy Fork to where it strikes the eastern boundary line of said grant; thence North, parallel with the western boundary line of said grant, to a point due East of the beginning corner of said grant; thence West three hundred thirty(330)poles, more or less, to the beginning; Excluding from the above conveyance all the coal in and under the above described land, which said coal has been heretofore conveyed, and also excluding from this conveyance twenty (20) acres, more or less, of land lying in the northeast corner of the above tract with a northern boundary of fifty (50) poles, more or less, and an eastern boundary of one hundred four (104) poles, more or less, and its southern and western line running a Northwesterly direction with a road, and being the property owned by Tim Tinch. The above tract, excluding said exceptions, contains a net total of one thousand thirty-five (1035) acres, more or less.

There is conveyed in the above two tracts a net total of one thousand two hundred ninety (1290) acres, more or less.

All references in the above descriptions to roads, corners and lands of third parties are hereby made “now or formerly”.

This conveyance is Subject to all existing easements and rights of way for public roads and highways and public utilities, if any, extending into, through, over, or across the above described property.

ALSO EXCLUDED from the above described parcel is a 16.77 acre tract of land as described on the plat of survey for JEDD, LLC, recorded on July 7, 2008, in Plat Book 6, Page 15, in the Register’s Office of Fentress County, Tennessee.
